On January 9, 2025, the U.S. District Court for the Eastern District of Kentucky issued a Judgment in State of Tennessee, et al., v. Miguel Cardona, in his Official Capacity as Secretary of Education, et al., that vacated the U.S. Department of Education’s 2024 Final Rule entitled “Nondiscrimination on the Basis of Sex in Education Programs or Activities Receiving Federal Financial Assistance” and its corresponding regulations.

In other words, the 2024 Title IX Final Rule and corresponding regulations are no longer effective. This action returns the law to the “status quo,” in this case, the 2020 Title IX regulations. Public school districts must ensure compliance with those 2020 regulations moving forward.

It is not expected that the incoming administration will appeal this decision.
