Identifying And Responding To Student Bullying And Cyberbullying

Addressing bullying and cyberbullying—the unwanted, aggressive behavior among students that involves a real or perceived power imbalance—has remained a hot topic in education law for more than a decade. This presentation explores the latest legal developments and guidance in this too-often problematic area. We will cover the legal definition of bullying and its characteristics; examples of bullying behavior; the difference between traditional bullying and cyberbullying; special protections for bullying by or against students with disabilities; and bullying prevention measures. The session also imparts important lessons for educators in identifying and responding to bullying, with numerous practical compliance takeaways.

Legal Parameters Of Student Expulsion

Expulsion of a student from school—which typically means the permanent removal of a student from all schools within a school district, generally due to serious misconduct or a pattern of behavior that poses a threat to the school environment—involves teachers, administrators and school boards in a complex decision-making process. This session focuses on the legal requirements governing the various circumstances under which a student may be recommended for expulsion; the expulsion process; notice and procedural protections; the expulsion hearing; post-expulsion educational programs; and more. Plus, we will provide practical pointers for school staff when faced with an expulsion decision.

Our 2025 Legal Update highlights recent developments in education law—and why they matter to educators. We will cover hot topics, including student privacy protections, artificial intelligence (“AI”), transgender student rights, the latest on Title IX, and much more; new case law decisions; recent state and federal guidance; new and pending legislation; and any late-developing news affecting students in California.
