“Take It Down Act” Cracks Down on AI-Created Explicit Content

The Take It Down Act, signed into law by President Trump, criminalizes generating, creating and/or distributing sexually explicit material, including images created using artificial intelligence (AI). 

A bi-partisan bill, the Take it Down Act, aims to protect victims from harassing and abusive behavior given the capability of AI technology to closely mimic authentic imagery. The law also requires social media platforms to remove flagged content within 48 hours. 

The California legislature has enacted similar laws as recently as last year. Schools should therefore take care to consider potential criminal liability in disciplining students for these behaviors.
