California Education Code section 35292.5(b)(1)(a) requires each school district, county office of education, and charter school to have  at least one all-gender restroom for pupil use, for school sites that already have more than one female restroom and more than one male restroom for students.  The restroom is to be operational on or before July 1, 2026.  Use of such restroom by pupils is voluntary.  The  all-gender restroom must meet the following requirements:

1. There must be signage indicating that the facility is open to all genders and in conformity with Title 24 of the California Building Code.
2. The all-gender restroom is to remain unlocked, unobstructed and easily accessible by any student during school hours and school functions.  The all-gender restroom must be consistent with existing pupil access to sex-segregated restrooms.
3. The all gender restroom must be maintained and cleaned regularly, and remain fully operational.  The all-gender restroom must be stocked at all times with toilet paper, soap, paper towels/functional hand dryers, and an adequate supply of menstrual products free of charge.
4. Each school site will need to designate a staff member to serve as a contact person for implementing the all-gender restroom.  
5. The school site must post a notice about the requirements of Education Code 35292.5(b)(1) in a “prominent and conspicuous location” outside at least one all-gender restroom, including the contact information designated contact person. 

A school district, county office of education, or charter school may use an existing restroom to satisfy the requirements of this law if it ensures that all pupils have restrooms that are in easily accessible locations and the existing restroom otherwise complies with requirements listed above.

Additionally, the provision of all-gender restrooms will be considered in applications for state funding.  Education Code section 17585 states that if a school district, county board of education, or governing body of a charter school applies for state funding for a school modernization project, the application shall include as part of the modernization project, an all-gender restroom designed for pupil use if the school district has not established an all-gender restroom pursuant to this law.
